Information regarding the application by CEC Bank of the provisions of Law no. 258/2017
1. In accordance with the provisions of Law no. 258/2017 on the comparability of fees related to payment accounts, change of payment accounts and access to payment accounts with basic services, CEC Bank makes available to customers in the category of individuals, the payment account with basic services.
2. The payment account with basic services is provided to the applicants in compliance with the provisions of Law 258/2017 both from the point of view of the types of operations / services included and from the point of view of the level of applied costs, as follows:
ARTICLE 48 (1) A payment account with basic services includes the following services: a) services that allow all the operations necessary for opening, administering and closing a payment account; b) services that allow the deposit of funds in a payment account; c) services that allow cash withdrawals on the territory of the European Union from a payment account at the counter or at ATMs, during or outside the working hours of the credit institution; d) carrying out the following payment operations on the territory of the European Union: (i) direct debtor; (ii) payment card payment transactions, including online payments; (iii) credit transfers, including scheduled payment orders, as appropriate, to bank terminals, counters and through the credit institution's online facilities. ARTICLE 53 In the case of financially vulnerable consumers, credit institutions offer free of charge: a) the services provided in art. 48 para. (1) lit. a) and b); b) the services provided in art. 48 para. (1) lit. c), if they are provided at counters or ATMs on the national territory; c) the first 10 monthly operations performed by a consumer by using the services provided in art. 48 para. (1) lit. d). The fees charged for operations exceeding the minimum number of transactions are not higher than those charged in accordance with the usual tariff policy of the credit institution. ARTICLE 54 In the case of consumers who do not meet the conditions provided in art. 4 lit. e), credit institutions: a) offers free of charge the services that allow all the necessary operations for opening, closing a payment account and the services provided in art. 48 para. (1) lit. c); b) may charge reasonable commissions for the services provided in art. 48 para. (1), except for the services provided in let. a). 3. At the same time, CEC Bank informs the applicants that in accordance with the provisions of art. 41 of Law 258/2017, consumers who do not have, at the time of the request, another payment account, including the opening of a payment account with basic services, may a basic payment account, at no other credit institution in Romania, the fulfillment of the condition in question being certified by the applicant through a declaration on his own responsibility:
ARTICLE 41 (1) All credit institutions offer to consumers payment accounts with basic services provided in art. 48, in order to guarantee the access to them of all consumers on the national territory and to prevent the distortion of competition. (2) Consumers who do not hold, at the time of the request, another payment account, including a basic payment account, at any other credit institution in Romania benefit from the opening of a payment account with basic services, except in the case of which the consumer declares to have been notified of the closure of the account. (3) The fulfillment of the condition provided in par. (2) shall be ascertained by the credit institution on the basis of its own queries, according to the legislation in force, or of the declaration on the consumer's own responsibility. 4. In accordance with the provisions of Article 14 of Law 258/2017, CEC Bank informs consumers about their right to choose between any payment account with payment services and a payment account with basic services: ARTICLE 14 Payment service providers shall inform consumers, clearly and unequivocally, in a timely manner, before concluding a payment account agreement with them, of their right to choose between any payment account and a payment account. with basic services, as well as on the costs related to the respective payment accounts. 5. In the case of clients requesting the opening of a payment account with vulnerable basic services, from a financial point of view, the proof of compliance with the mentioned condition is made on the basis of the income documents presented by the client in this respect. 6. The vulnerability criterion, from a financial point of view, is periodically verified by the Bank on the basis of the documents provided by clients, as it results from the payment account purchase contract with basic services that will be made available to them at account opening.
