Terms and conditions for using the cards issued by CEC Bank in Apple Pay
CEC BANK S.A. (hereinafter referred to as the “Bank” or “CEC Bank”) is a credit institution, a Romanian legal entity with headquarters in Bucharest, Calea Victoriei no. 13, District 3, telephone: 021.314.28.68, fax: 021.310.09.11, trade Register no. J40/155/1997, Bank Register no. RB–PJR–40–046/17.09.1999, share capital 2.290.661.600 lei, Fiscal Code RO 361897, CUI 361897.
As of 15.03.2020, CEC Bank allows the payment with eligible CEC Bank cards (hereinafter referred to as "CEC cards") also in the Apple Pay payment app (hereinafter referred to as "Apple Pay"). Details regarding the CEC cards eligible for registration and use in Apple Pay are available in the dedicated section of these Terms
With regard to Apple Pay solution and who Apple is, you can find details on www.apple.com. Please read carefully the "Terms and Conditions" (hereinafter referred to as the "Terms") governing the registration, activation and use of a CEC card in Apple Pay.
If there is any inconsistency between the terms of your Apple account and these Terms, these terms for payments made with the CEC card in Apple Pay shall apply.
These Terms shall apply only to the use of CEC cards in Apple Pay.
These Terms do not apply to the services / products contracted / purchased from the supplier of the device you use, the mobile network and from other sites or services belonging to third parties which integrate or allow the provision of Apple Pay. These are third parties in relation to CEC Bank and have their own contracts that you must comply with when you provide information about yourself, when you use their services or when you visit their websites. CEC Bank is not responsible for the legality of supplying / providing the products / services of the device and / or third-party supplier, nor for the security, accuracy, legality nor any other aspect of the relevant products / services offered by them.
We are not responsible and do not provide any support or assistance for any hardware, software or other third party products or services (including Apple Pay and your device). If you have any questions or issues with a product or service offered by Apple or a third party, please contact the respective supplier / third party for assistance.
CEC cards eligible for registration and payment in Apple Pay are cards issued by CEC Bank, regardless of whether they are debit or credit cards, and whether they are issued on behalf of a client who is natural person or legal entity.
Both CEC cards issued on behalf of the card holder and on behalf of the designated holder can be registered in Apple Pay, according to the provisions of the section “Registration of a CEC card in Apple Pay” included in these Terms.

To use your CEC card in Apple Pay you must first own or create an Apple account, as required by Apple. At the same time, you need a compatible device.
You can add the same CEC card to multiple devices at the same time. The device vendor may impose limitations or restrictions on the use of Apple Pay and / or may have minimum software and hardware requirements for the compatible device used. Compatible device means any smartwatch, bracelet, smartphone or other device that allows payments via Apple Pay. Compatible devices are those presented on the Apple website - www.apple.com
You agree to use the CEC card only with a device properly equipped for Apple Pay and to comply with all Apple Pay applicable terms and conditions. You need to contact your device provider directly to find out if your device is compatible for use in Apple Pay.
Prior to registration in Apple Pay, you need to make sure that only your password / security details are related to the CEC card you want to use on that device in Apple Pay. Such password / security details will be used to authorize transactions with the CEC card issued on behalf of the card holder.
CEC Bank is not responsible in any way for the requirements of Apple or third parties with which it collaborates to impose conditions for the creation of the Apple account or for compatible devices.
Before entering your CEC card data in Apple Pay you will be prompted to set a password / security details, which you will use to access Apple Pay. The conditions, cases and frequency with which you will be asked to enter this password / security details are established by the Apple Pay provider.
If you know or think that the password you have set has been compromised (for instance, it has come to the knowledge of other people), we recommend that you change it immediately.
Please contact CEC Bank urgently at the telephone number printed on the back of the CEC card, at least in the following situations:
- If the CEC card you registered in Apple Pay is lost or stolen, contact us immediately and let us know that it is registered also in Apple Pay.
- If your device is lost, stolen or used without your consent.
CEC Bank accepts no responsibility for payments made with the CEC card registered in Apple Pay until we are informed about the occurrence of any of the above mentioned events or until it is requested to block this card.
CEC Bank accepts no liability for the case where the CEC card was used by other persons for payments through Apple Pay based on your password, whether the password was communicated by you or obtained by such persons, in any way, without your consent.
In order to prevent the occurrence of events like the above mentioned ones, we recommend the following:
- Keep the device safe and in your possession at all times
- Keep the security information and password of the device secured and known only by you
- Set passwords / security details for your CEC card in Apple Pay different than those used for the physical CEC card.
- Do not keep CEC cards in physical format and / or the details of CEC cards together with the device used
- If you start using a new device, delete all the cards and other personal information from the old device. For details on how to proceed, follow the instructions of the device vendor.
You undertake to work with CEC Bank and / or any competent authority to prevent any type of fraud, or to conduct any investigations that would be required with regard to the use of your CEC card registered in Apple Pay.
Apple Pay and your device may have certain features and security procedures to protect against unauthorized use of any card. These functionalities and procedures belong exclusively to the device supplier. By registering your CEC card in Apple Pay you agree not to disable any of these security features and use them to protect all CEC cards registered in Apple Pay. CEC Bank does not control these security methods and is not responsible for how Apple and / or your device provider I using them.
After setting the password / security details, you will be asked to enter the data of the card you want to register in Apple Pay, which are required by the Apple Pay provider to allow you to use the CEC card payment through this App. Details about these data are available in section XIV of these Terms - “Personal data processing”
To ensure that the person trying to register a CEC card in Apple Pay is entitled to request this registration, CEC Bank will need to verify the identity of that person. To this end, in order to complete the registration of the CEC card in Apple Pay, after entering the data of the CEC card in this App, it will be necessary that, as the case may be, the holder of the card issued on behalf of a natural person or the legal representative of the legal entity on whose name the CEC card is issued, contact the CEC Contact Center service, at phone numbers (021) 202.69.99 / 315.71.00, where a CEC Bank representative will request information to ensure the identification and allow the corresponding token to be set for the CEC card which will be used in Apple Pay.
The token is a virtual representation of the CEC card intended for registration in Apple Pay. The token is set by CEC based on the information about the device used to access the Apple account, as this information is made available to the bank through Apple and / or the third parties with which it collaborates.
Refusal to provide this information, some of which are personal data, will make it impossible to complete the CEC card registration in Apple Pay and its use for payment in said App will not be possible.
After completing the CEC card registration in Apple Pay, in the CEC Contact Center, this CEC card can be used to pay via Apple Pay.
The use of CEC cards in Apple Pay for the purchase of goods and services is governed by the terms and conditions of the CEC card, which are an integral part of the General Business Terms of CEC Bank applicable to CEC clients, natural or legal persons, as the case may be.
You are also responsible for all uses and transactions made with the CEC card in Apple Pay by third parties to whom you have given, voluntary or involuntary, access to your card registered in CEC Pay, including in the cases when such third parties misuse any card or Apple Pay.
These Terms govern the access and use of the CEC card in Apple Pay only between you, as a CEC card holder, and the bank.
The provider of devices with which payments can be made via Apple Pay, as well as the Apple Pay solution or third parties with whom they collaborate, may have their own terms and conditions and privacy policies. Please be aware that you are bound by such terms and conditions or privacy policies when using Apple products and services. CEC Bank undertakes no responsibility for the way Apple and / or third parties with whom it collaborates are using the information you make available to them, or your personal data that they process in the context of the services they offer or when you visit their websites.
a. Making payments with the CEC card via Apple Pay
Apple Pay allows you to make contactless payments using a registered card, at the POS installed at different merchants, through the device you use. By selecting a virtual card and placing the device you are using near a contactless POS terminal at a merchant's location, you authorize the payment for the merchant's products or services.
b. Viewing information and payments made with the CEC card in Apple Pay
CEC Bank offers you information about payments made with your CEC card registered in Apple Pay, through the info channels agreed with the bank (for instance, statement of account, Internet Banking, at CEC Bank agencies, etc.). This information will be highlighted as payments made with the relevant CEC card, without indicating that the payments were made via Apple Pay. Apple Pay can also give you access to information about payments made with the CEC card via Apple Pay. Data about such option availability, as well as information about said option will be provided by Apple.
c. Termination of CEC card in Apple Pay
In addition to any rights to terminate the use of a CEC card and / or the card account attached to it, as established by the General Business Conditions of CEC Bank, the bank reserves the right to entirely cease offering the possibility to use the CEC cards in Apple Pay. Also, CEC Bank has the right to block, restrict, suspend or cease offering the possibility of using any CEC card in Apple Pay if these Terms, the General Business Conditions of CEC Bank, the conditions stipulated in the card agreements, Apple Pay terms are violated or if you suspect any fraudulent or improper card activity in Apple Pay or other payment platform.
In addition, if Apple Pay device and / or App supplierr blocks, restricts, suspends, or interrupts Apple Pay App and / or changes its functionality, CEC Bank will not be liable to its clients with CEC cards registered in Apple Pay or to third parties.
Currently, CEC Bank does not charge any fees for the use of your CEC card via Apple Pay. If, in the future, CEC Bank will decide to collect such fees, it will notify its clients with at least two months before applying such fees.
Please note, however, that the supplier of your Apple Pay device, and / or third parties with whom it collaborate may charge fees, may impose limitations and restrictions which could impact your use of any CEC card in Apple Pay, such as, but without limitation to the use of data or fees related to text messaging charged by the mobile telephone service provider. You are solely responsible for paying these fees and you agree to observe any limitations or restrictions imposed.
The access, use and maintenance of the virtual CEC card depend on Apple Pay and the network of your internet provider. CEC Bank does not operate Apple Pay or such networks and has no control over their operations. CEC Bank will not be liable for any situation which interrupts, impedes or otherwise impacts the operation of any CEC card in Apple Pay, such as, but not limited to the unavailability of Apple Pay or Internet service, communications, network delays, limitations regarding Internet network coverage, system outages.
We reserve the right to review these Terms at any time, in accordance with the provisions of the General Business Conditions of CEC Bank.
We will notify you of the changes made to these Terms by e-mail or other communication method provided in the section below. You will also be able to view the reviewed Terms on your device. If you do not agree with the reviewed Terms, you may remove any of the CEC cards from Apple Pay, at any time.
With regard to the activation and use of the CEC card in Apple Pay, CEC Bank may need to contact you. For this purpose, any of the contact details of the card holder will be used - correspondence / home address, e-mail address, telephone number, as specified in the CEC records.
As the operator the personal data of the CEC card holders who wish to complete their registration in Apple Pay, as well as in the context of using the CEC card payment via Apple Pay, CEC Bank is processing data as mentioned below:
- for the registration of the cards in Apple Pay - it will be necessary to process the card number, the expiry date of the card, the name of the card holder, as it is marked on the card, the CVV code, as well as the postal address.
- to verify / validate the identity of legal persons entitled to request the registration of CEC cards in Apple Pay (details in section VI of these Terms) - during the call made to CEC Contact Center service, we will request the identity data that you have declared to the bank. and / or, as the case may be, data about the transactions or Bank’s products / services you use, to ensure that you are the right person to request the registration of a specific CEC card in Apple Pay
- for your contact related to the CEC cards registered in Apple Pay (details in sections XI and XII of these Terms) we will use the contact details you have declared to the bank for the purpose of the business relationship you have with the bank.
- to ensure the security of the App and data entered in the App - we process data such as the ones about the device where you downloaded the App (operating system, IMEI, etc.) and the IP address
